Cannabis Trafficking (Bringing Cannabis Into Illinois From Out-Of-State)

Illinois Statute 720 ILCS 550/5.1

  • Under Illinois law it is unlawful for any person to bring into, or cause to be brought into, the state over 2,500 grams of cannabis and to knowingly deliver, manufacture, or possess with the intent to deliver the cannabis.
  • If the amount is 2,500 to 5,000 grams (5.511 to 11.023 pounds) then it is a Class 1 Felony punishable by 8 – 30 and a fine up to $300,000 with a mandatory assessment of $2,000 where the offender could receive probation.
  • If the amount is over 5,000 grams (11.023 pounds) then it is a non-probationable Class X Felony punishable by 12 – 60 and a fine up to $400,000 with a mandatory assessment of $3,000.
