Offenses involving motor vehicles in Illinois are governed by both the Illinois Vehicle Code and the Criminal Code. There are anti-theft laws and other violations contained in both codes.

The lowest level of criminal motor vehicle offenses start with Criminal Damage to a Motor Vehicle and Trespass to a Motor Vehicle which are usually charged as a misdemeanor and as the seriousness of the accusations increase the offenses can escalate to non-probationable Class X felonies such as Aggravated Vehicular Hijacking.

Not only does a person charged with a vehicle offense face potential jail time, but even for the first offender there is the possibility of losing their driver’s license even if not sentenced to the penitentiary.
