Truth in Sentencing (How Much Time in Jail)

For all sentences that include prison a person will only serve 50% of the sentence if the Department of Corrections has determined that they have behaved well in custody and deserve good time credit except for the following circumstances:

A person will serve 100% of the time sentenced for First Degree Murder.

Mandatory 85% of the time sentenced to for the following offenses:

• Aggravated Arson
• Aggravated Battery of a Child
• Aggravated Battery with a Firearm
• Aggravated Battery with a Machine Gun or Silencer
• Aggravated Battery of a Senior Citizen
• Aggravated Discharge of a Firearm
• Aggravated Discharge of a Machine Gun or with a Silencer
• Aggravated Domestic Battery
• Aggravated Criminal Sexual Assault
• Armed Habitual Criminal
• Aggravated Kidnapping
• Attempt First Degree Murder
• Attempt to Commit Terrorism
• Criminal Sexual Assault
• Heinous Battery
• Intentional Homicide of an Unborn Child
• Luring a Minor (Second or Subsequent offense)
• Predatory Criminal Sexual Assault of a Child
• Reckless Homicide [Under the Influence of Alcohol or Drugs]
• Solicitation of Murder
• Solicitation of Murder for Hire

85% of the time sentenced to for the following offenses when there is a finding that the conduct resulted in Great Bodily Harm:

• Aggravated Vehicular Hijacking
• Armed Robbery
• Armed Violence (Category I or II Weapon)
• Home Invasion

75% of the time sentenced to for the following offenses:

• Aggravated Methamphetamine-Related Child Endangerment
• Class X felony conviction for Delivery of a Controlled Substance
• Class X felony conviction for Possession of a Controlled Substance with Intent to Manufacture or Deliver
• Class X felony conviction for Calculated Criminal Drug Conspiracy
• Class X felony conviction for Criminal Drug Conspiracy
• Class X felony conviction for Street Gang Criminal Drug Conspiracy
• Class X felony conviction for Participation in Methamphetamine Manufacturing
• Class X felony conviction for Aggravated Participation in Methamphetamine Manufacturing
• Class X felony conviction for Delivery of Methamphetamine
• Class X felony conviction for Possession with Intent to Deliver Methamphetamine
• Class X felony conviction for Aggravated Delivery of Methamphetamine
• Class X felony conviction for Aggravated Possession with Intent to Deliver Methamphetamine
• Class X felony conviction for Methamphetamine Conspiracy when the Substance Containing the Controlled Substance or Methamphetamine is 100 grams or more
• Controlled Substance Trafficking
• Drug-induced Homicide
• Gunrunning
• Methamphetamine Trafficking
• Narcotics Racketeering
• Money Laundering (pursuant to clause (c) (4) or (5))
